Depending on the violation, your driving history, your license, and the court handling your case, one option may be available when the other is not.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As a Texas traffic ticket attorney, I encourage drivers not to simply pay a ticket without first understanding their options. Paying a ticket can result in a conviction. Before you make that decision, it is worth understanding what defensive driving and deferred disposition actually mean and whether either may apply to your situation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Is Defensive Driving for a Texas Traffic Ticket?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">What most people call &#8220;defensive driving&#8221; is officially a <strong>driving safety course dismissal<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For eligible Texas traffic offenses, you may be able to request permission to complete a state-approved driving safety course. You generally enter a guilty or no contest plea, but the court defers imposition of the judgment while you complete the requirements. If you satisfy those requirements, the eligible charge is dismissed. Texas law provides that a charge dismissed through this process may not become part of your driving record or be used for any purpose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A driving safety course used for ticket dismissal must be approved by the Texas Department of Licensing and Regulation. Eligibility depends on several factors.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who Can Use Defensive Driving to Dismiss a Texas Ticket?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Texas law establishes specific eligibility requirements for driving safety course dismissals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, the law generally requires an eligible driver to have a Texas driver&#8217;s license or permit, although there is an exception for certain active-duty military members and their spouses or dependent children. The driver also generally cannot have completed a driving safety course for ticket dismissal during the 12 months preceding the date of the current offense. Proof of financial responsibility is also required.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are also important limits for speeding offenses. Under current Texas law, the standard driving safety course dismissal is unavailable when the alleged speed is <strong>95 mph or higher<\/strong> or <strong>25 mph or more above the posted speed limit<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Certain other offenses are also excluded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is one reason I recommend understanding your eligibility before simply signing up for an online defensive driving course. Taking a course on your own does not necessarily mean the court will dismiss your ticket.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Is Deferred Disposition in Texas?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Deferred disposition works differently.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Think of it as a probation-like period for an eligible ticket. Under Texas law, a judge may defer further proceedings for up to 180 days without entering an adjudication of guilt. The judge can impose conditions that you must satisfy during that period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those conditions vary depending on the case and the court. They may include requirements such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Avoiding additional violations during the deferral period<\/li>\n\n\n\n<li>Completing a driving safety course<\/li>\n\n\n\n<li>Paying applicable court costs or fees<\/li>\n\n\n\n<li>Completing another program ordered by the judge<\/li>\n\n\n\n<li>Providing evidence that all conditions were satisfied<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If you successfully comply with the judge&#8217;s requirements, the court dismisses the complaint. Texas law states that there is then no final conviction and that the complaint may not be used against you for any purpose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you fail to satisfy the conditions, however, you may face a show cause hearing and potentially a final conviction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That makes it important to understand exactly what the court expects of you and when each requirement must be completed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Defensive Driving vs. Deferred Disposition: What Is the Difference?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The biggest practical difference is how the two options work.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Defensive driving<\/strong> is a specific statutory dismissal process with defined eligibility requirements. If you qualify and properly request it, you complete the approved course and satisfy the other requirements within the required time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Deferred disposition<\/strong> gives the judge more discretion. Instead of following only the driving safety course process, the court places your case into a deferral period and sets conditions that must be completed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Interestingly, defensive driving can sometimes become part of deferred disposition. Texas law allows a judge to require completion of an approved driving safety course as one of the conditions of deferred disposition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So the two options are different, but they are not necessarily mutually exclusive.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Which Option Is Better for a Texas Traffic Ticket?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is no universal answer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a straightforward eligible violation, defensive driving may provide a relatively predictable path toward dismissal. The requirements are established by Texas law, and many drivers are familiar with the process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Deferred disposition may make sense in other circumstances, particularly when the normal driving safety course option is unavailable or when the court agrees to conditions appropriate to the particular case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But I would not choose between them based solely on which sounds easier.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would first want to know:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What exactly are you charged with?<\/li>\n\n\n\n<li>How fast were you allegedly driving?<\/li>\n\n\n\n<li>What type of driver&#8217;s license do you hold?<\/li>\n\n\n\n<li>Have you used defensive driving recently?<\/li>\n\n\n\n<li>Are there multiple violations on the citation?<\/li>\n\n\n\n<li>Which court is handling the case?<\/li>\n\n\n\n<li>Are there circumstances that might support another resolution?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Every case is different. Your ticket and your circumstances should drive the decision.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What If I Am Under 25?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Texas has additional rules for younger drivers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When a defendant under age 25 receives deferred disposition for a moving violation, Texas law requires the judge to order completion of an approved driving safety course during the deferral period. Drivers with provisional licenses may have additional requirements involving the Texas Department of Public Safety.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So if you are under 25, do not assume that choosing deferred disposition means you can avoid taking a driving safety course. In some situations, the course is mandatory.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What About CDL Drivers?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Commercial drivers need to be especially careful.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Texas law excludes people who hold a commercial driver&#8217;s license, or held one when the offense occurred, from the statutory driving safety course dismissal process. Texas law also excludes CDL holders from the deferred disposition provisions for motor vehicle control violations, other than parking violations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you have a CDL, your situation therefore deserves separate consideration from that of a non-commercial driver.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do not assume that advice from a friend, an online forum, or even another driver who received a similar ticket applies to you. CDL traffic violations can involve different rules and consequences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I recommend talking with an attorney who handles Texas CDL tickets before deciding how to respond.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Should I Just Pay the Ticket Instead?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Paying may seem like the simplest solution. Depending on the circumstances, defensive driving, deferred disposition, a negotiated resolution, or another approach may be available.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once you know your options, you can make an informed decision instead of simply choosing the fastest one.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Happens If I Miss the Deadline?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Deadlines matter with both defensive driving and deferred disposition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a driving safety course dismissal, Texas law generally requires the request to be made on or before the appearance date stated on the citation, although a court may have authority to grant a later request before final disposition. After the request is granted, you generally have 90 days to satisfy the course and documentation requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Deferred disposition has its own court-ordered requirements and deadlines.
