Dr. Newton is the “Texas Ticket Doctor.”
Having received far too many tickets when he was first licensed to drive, Dr. Newton understands how easy and painful it is to get pulled over. While growing up in West Texas, Dr. Newton had the fun of owning an old ’67 Chevy V-8, which, coupled with the flat open roads of West Texas, resulted in him receiving numerous tickets during high school, followed by having his license suspended and nearly being arrested for driving with a suspended license. Thankfully, Dr. Newton survived that youthful stage of life and went on to become a safe driver, obtaining multiple degrees, culminating in two doctorates: one in philosophy (Ph.D.) and one in law (J.D.).
After graduating from law school, Dr. Newton ironically worked as a municipal prosecutor for a dozen small courts from Del Rio to Gonzales, Texas, where he took part in dishing out the very tickets that he inwardly loathed. However, during his time as a prosecutor, he learned how courts and police officers operate, confirming his deep-seated suspicion that many of them are simply out to make money and are willing to use questionable means to do so.
Unhappy with his work as a prosecutor, Dr. Newton eventually decided to start his own firm—Newtons Law Tx—which is the general practice firm that oversees the TxTicketDr.com. Although Newton’s Law provides a full range of legal services, from estate planning to family issues, Dr. Newton spends most of his personal and professional time concentrating on defending clients who have received traffic tickets, especially for clients holding a commercial driver’s license (CDL), in homage to his own grandfather and uncle, who made their living and provided for their families by driving trucks.
Dr. Newton has seen far too many citizens get steamrolled by the judicial system for alleged traffic violations. Our judicial system, especially as it pertains to traffic violations, only functions because 99% of those who receive a traffic citation are unwilling to fight. Remember, you are innocent until proven guilty—unless, of course, you admit and simply pay the fee. But pleading “guilty” or even “no contest” will most likely result in your insurance premiums increasing by 20-30%, and for many who drive for a living, it will likely cost you your job or even your livelihood.
But just because an officer alleges that you broke a traffic law—even if you know and admit that you were going over the speed limit—that is not necessarily illegal. In Texas, there are plenty of times when you are not only allowed to break the speed limit, you must do so. In addition, the posted speed limit is prima facie evidence that the posted speed is reasonable, but that is a presumption of what is reasonable and prudent—a presumption that can be overcome by the right attorney. In fact, the law is not that you must drive the posted speed limit. No, the law states that you must not operate a motor vehicle “at a speed greater than is reasonable and prudent under the circumstances.” But the law also states that a driver must “not drive so slowly as to impede the normal and reasonable movement of traffic.”
What all this means is that you are far better off challenging every citation, regardless. Yes, attorneys are expensive, but not as expensive as the increase in your insurance premiums for the next three years when you pay your ticket and get a conviction for a moving traffic violation on your record. Nor is an attorney as costly as losing your job, especially when you drive for a living.
